We collect, use and disclose personal information in line with this policy and the Australian Privacy Principles in the Privacy Act 1988 (Cth) (the Privacy Act). Because Professional Edge Lawyers provides services regulated by the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) (the AML/CTF Act), the Privacy Act applies to us in relation to personal information we handle for the purposes of the AML/CTF Act (s 6E(1A)). What we collect

When you contact us, we collect the details you give us. The enquiry form on this website asks for your name, email address, phone number and preferred language. It also asks how you would like us to reply, the state or country where you live, and the type of matter.

You can describe your matter in the form. If we act for you, we collect the information we need to provide legal services. Because of the nature of legal services, we cannot generally deal with people who do not identify themselves.

How we collect it

We collect personal information directly from you, including through the enquiry form on this website, by email and by phone. With your consent, we may also collect information from your other advisers or from other parties to your matter.

Conflict check

Before we act, we check that we do not already act for anyone whose interests conflict with yours, such as the other party. We use the names you give us for that check.

How we use and disclose it

We use your information to respond to your enquiry and, if we act for you, to provide legal services. In the course of a matter we may disclose information to the other party, barristers, courts, tribunals, other parties’ lawyers and service providers we use to run the practice, in accordance with our professional duties. We may disclose information where the law requires it.

If your matter involves Polish law, we may, with your agreement, give a lawyer or notary in Poland the information they need to help.

Where it is stored

Enquiries sent through this website are emailed to our practice mailbox. The form entries are also kept in this website’s form records, which only the firm can access, for 12 months. They are then deleted automatically.

Documents you send us go only to the firm. We use software and IT services from providers such as Microsoft and Google, whose servers may be in Australia or overseas. We take reasonable steps to ensure that overseas recipients handle personal information consistently with the Australian Privacy Principles.

Website analytics and cookies

This website uses Google Analytics to understand how visitors use it, such as the pages visited and the site that referred you. Google Analytics uses cookies. You can opt out by installing the Google Analytics opt-out browser add-on, or by blocking cookies in your browser.

The website also stores the language you choose in a cookie, so that the PL | EN button opens the right version of each page. The cookie is called pll_language and is kept for one year.

Access and correction

Subject to the Australian Privacy Principles, you can ask for access to the personal information we hold about you, or ask us to correct it. Contact our privacy officer at info@polishlawyer.com.au or 435 Nepean Highway, Frankston VIC 3199.

Complaints

If you have a complaint about how we have handled your personal information, contact our privacy officer. If you are not satisfied with our response, you can contact the Victorian Legal Services Board and Commissioner, which deals with complaints about lawyers, including complaints about confidentiality. If your complaint concerns personal information we collect or hold for the purposes of the AML/CTF Act, you can also contact the Office of the Australian Information Commissioner at www.oaic.gov.au or on 1300 363 992.
